Caught in the Middle: Guidelines for Handling Custody Disputes
Conflicting directives from separated or divorced parents often lead to confusion for school leaders. This session explains legal requirements and practical strategies for managing custodial disputes. Participants will learn how to determine who has educational decision-making rights and how court orders can change those rights, understand the differences between physical and legal custody and their impact on school decisions, recognize rights and limitations regarding access to student records, learn how to interpret and comply with restraining orders, and address special considerations involving foster youth and students with disabilities.

Stacy Tolkin’s primary practice areas include special education, student discipline, and Section 504. Before pursuing a career in law, Stacy spent over 25 years in public education, beginning as a school psychologist. She has worked with students from preschool through postsecondary education. After obtaining her administrative services credential, she held educational leadership roles, including district program specialist, SELPA coordinator, and director of special education. Stacy began her collaboration with charter schools approximately nine years ago. Stacy is a skilled IEP facilitator trained in various facilitation and mediation techniques.
